Mediation is a form of conflict resolution which helps clients come to a mutually acceptable agreement, without going to court. It is sometimes described as "alternative dispute resolution", meaning alternative to litigation.
Mediators do not take the side of one party or the other. They are impartial third parties trained to guide and facilitate negotiation between the individuals until they reach a settlement each feels is fair and reasonable.
Due to emphasis on points of agreement and calm, respectful communication, clients frequently find mediation to be a less tense, more positive, and more effective way to settle their differences than trying to reach resolution on their own, or with the assistance of family members (who may find it impossible not to take sides), or by taking their case to court.
Since no court dates must be arranged, it also tends to be a much more rapid way to finalize outstanding matters.
Since only one professional is employed by both parties (rather than each party needing to secure individual representation), and since hourly rates are significantly lower than traditional legal fees, mediation also tends to be a highly cost-effective way to bring conflict to an end and move on with one's life.
Perhaps the greatest advantage of mediation is that clients can customize their agreement to their specific needs and circumstances. As a result, they may be more content with results than cases where a judge imposes the decisions - which then become legally binding upon them.
